EPBD implementation update

 

We have recently received clarification from CLG on a number of issues relating to the final implementation of the EU Energy Performance of Buildings Directive (EPBD). This is new information and needs to be considered to ensure all the correct procedures are undertaken.

 

Transitional arrangements for Commercial EPCs

There has been an extension of the transitional arrangements for Commercial EPCs until 4th January 2009, (the final date for implementation allowed under the EPBD).

 

As a reminder, the timetable for EPC implementation is:

 

April 2008: All commercial buildings above 10,000m2 and all newly
constructed buildings, regardless of size.

 

July 2008: All commercial buildings above 2,500m2

 

Oct 2008: All commercial buildings regardless of size

 

New transitional arrangements:

The revised arrangements are as follows:

 

If a building is already on the market on the date the implementation occurs for its particular size, it does not require an EPC immediately. It will now need an EPC by either of the following, whichever is sooner; the date that the building is sold or rented or January 4th 2009.

 

Example 1:  A building or property less than 2500m2 is put on the market on Sept 15th 2008.

 

Action: It will not need an EPC on October 1st.  It will need an EPC at the time of sale or rent, or by January 4th 2009, whichever is sooner.

 

Example 2: A building or property greater than 2500m2 is put on the market on Sept 15th 2008.

 

Action: It will need an EPC immediately since the commencement date for that size was July 1st and the building was not on the market at that time.

 

What this means for the market:

All buildings will still need an EPC. The total market for Commercial EPCs remains unchanged.  But what this transitional arrangement does is smooth out the demand and does not add to the current, exceptional demand for EPCs on 1st October. However there is no doubt that there will still be a huge bottle neck of EPCs required, irrelevant of property size.

 

We would strongly advise that you continue to prioritise your stock and make arrangements for EPCs to be completed irrelevant of size as soon as possible. The final deadline for EPCs to be in place for all Commercial Buildings being sold or let is now January 4th 2009.
